Prescription
Prescription is a legal rule in terms of section 126B of the National Credit Act that can cancel a debt if it is not claimed within a certain period, usually 3 years.
This applies if the debtor has not acknowledged the debt or made payment during that time. If they do, the prescription period starts again from that date.
However, if the debtor acknowledges the debt or makes a payment within this period, the clock resets. The new period begins from the date of acknowledgement or payment.
